1. IDENTIFICATION

2. SCOPE OF APPLICATION

These Terms and Conditions of Sale (T&C) apply to all orders placed on noctelya.com by a consumer residing worldwide. Any order implies full acceptance of these T&C.

3. PRODUCTS

The products offered comply with applicable legislation. Photographs and descriptions are for guidance only. NOCTELYA strives to reproduce them as accurately as possible.

4. PRICES

Prices are indicated in euros, including all taxes. NOCTELYA reserves the right to modify its prices at any time, provided that the applicable price is the one in effect at the time of order validation.

5. ORDER

Any order constitutes acceptance of the prices and descriptions of products available for sale. NOCTELYA reserves the right to cancel or refuse any order in case of an existing dispute with the customer or suspected fraud.

6. PAYMENT

Payment is made online by credit card or via payment methods available at checkout (Apple Pay, PayPal, Klarna, etc.). Transactions are secured by SSL protocol. Banking information is never stored on our servers.

7. DELIVERY

Orders are shipped within 24 business hours. Delivery is free worldwide. A confirmation email with tracking number is sent to you upon shipment. NOCTELYA cannot be held responsible for delivery delays in case of force majeure or delays attributable to the carrier.

8. RIGHT OF WITHDRAWAL AND RETURNS

In accordance with applicable consumer protection laws, you have a 14-day period from receipt of your order to exercise your right of withdrawal, without having to provide justification.

Beyond this legal period, NOCTELYA offers you an extended 30-night satisfaction guarantee. If the product does not suit you after 30 nights of trial, contact us at contact@noctelya.com. We will send you a prepaid return label within 24 hours. Full refund is processed within 5 business days after receipt of the package.

Return shipping costs within the legal right of withdrawal (14 days) are the customer's responsibility. Return shipping costs within the extended satisfaction guarantee (30 nights) are covered by NOCTELYA.

9. LEGAL WARRANTIES

In accordance with applicable consumer protection laws, NOCTELYA is bound by legal warranties of conformity and hidden defects. In case of lack of conformity, the customer may require repair or replacement of the product.

Furthermore, NOCTELYA offers a commercial warranty of 5 years against any manufacturing defect. In case of a defect, the product is replaced free of charge.

10. LIABILITY

NOCTELYA cannot be held responsible for damages resulting from misuse of the product or use not in accordance with the instructions provided. In accordance with applicable law, our liability is limited to the amount of the order concerned.

11. PERSONAL DATA

Data collected during your order is processed in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR). You have the right to access, rectify, and delete your data by contacting contact@noctelya.com.

12. DISPUTES

In case of dispute, an amicable solution will be sought as a priority. Failing that, you may use free consumer mediation services in accordance with applicable consumer protection laws. These T&C are governed by French law. Any dispute falls under the jurisdiction of French courts.
